Registration
Agreement
This
registration agreement ("Agreement")
contains the terms and conditions of your
use of X9 Internet's domain name
registration and related services
("Services"). In this Agreement "you" and
"your" refers to you or any agent,
employee, member of staff or a person
authorised to act on your behalf and
registered listed in the WHOIS contact
information for the domain name. "We",
"us" and "our" refers to X9 Internet, and
its subsidiaries and affiliates. This
agreement describes our obligations to
you, and explains your obligations to us
for various services offered by X9
Internet.
1.0 YOU AGREE TO THIS AGREEMENT. You agree
that by using the service (s) provided by
X9 Internet, you confirm that you have
read and agree to all terms and conditions
as well as those terms and conditions
which are attached to this Agreement, the
accompanying dispute policy and relevant
rules or policies, the Uniform Dispute
Resolution Policy ("UDRP"), and the rules,
guidelines or agreements in connection
with special service (s) provided by the
Internet Corporation of Assigned Names and
Numbers ("ICANN").
If you have a domain name in the following
extensions: .UK, .INFO, .BIZ, .ME, .CN,
.BZ, .VC, .HN, .SC, .AG or any new style
domain extension such as .photography,
.solutions, .technology or .today, you are
also agreeing to additional terms and
requirements from the appropriate
registries and such terms and conditions
become part of these terms and
conditions.
2.0 CHANGES TO THIS AGREEMENT. This
agreement may change as requirements of
governments, administrative bodies or
legislation requires such. If, when this
Agreement is subject to a change and you
do not wish to agree with its terms, you
agree to transfer your domain to another
service provider, or you agree to cancel
your domain registration. Should you
decide to cancel your Agreement with X9
Internet you will not receive a refund for
unused time which you have already paid to
X9 Internet. You agree to review this
Agreement from time to time to make
yourself aware of any such revisions.
3.0 TERM. The term of this Agreement shall
continue in full force as long as you have
a domain registered through X9
Internet.
4.0 SERVICES PROVIDED AND SERVICE
TERMINATION. We may reject your domain
name registration application or elect to
discontinue providing Service(s) at any
time, without limitation, for a prohibited
domain, abuse of Services, payment
irregularities, material allegations of
illegal conduct, or if your use of the
Services involves us in a violation of any
Internet Service Provider (ISP) acceptable
use policies, including sending out
spam.
5.0 OUR SERVICES. We are an approved
Nominet registrar and can register all
domains ending in .uk. All domains not
ending in .uk are provided to you from
joker.com. Domain name registrations are
not effective until the registry
administrator puts them into effect.
Domain name registrations are only for
limited terms, terms which end on the
expiration date. The beginning of the term
is the date the domain name registration
is acknowledged by the applicable
registry. You agree that we are not liable
or responsible in any way for any errors,
omissions or any other actions by the
registry administrator arising out of or
related to a request to register, renew,
modify settings or transfer of a domain
name.
6.0 ENTITLEMENT TO DOMAIN NAME. We do not
check if the domain name you register
infringes legal rights of others. It is
your responsibility to know this. We may
be ordered by a court to cancel, modify,
or transfer your domain name and you are
required to communicate with litigants,
potential litigants or government
authorities when such a situation arises.
We will comply with court orders unless
you contact us to contest the order.
7.0 LEGAL ACTIONS. If we are sued or
threatened with a lawsuit or legal
proceedings in connection with Service(s)
provided to you, you agree to indemnify us
and hold us harmless from any claims or
expenses including lawyer fees and court
costs.
8.0 DISPUTE RESOLUTION POLICY. You agree
to the Dispute Resolution Policies
applicable to your domain name and you
also agree that in the event a domain name
dispute arises with a third party, you
will indemnify and hold us harmless
pursuant to the terms and conditions of
the Dispute Resolution Policy. You also
agree that you will regularly monitor
email sent to the email address associated
with your account and domains. If a
dispute arises regarding Service(s)
provided to you, you may lose your rights
to receive Services if you do not respond
in a timely manner.
9.0 FEES AND PAYMENT. You agree to pay,
before a domain is registered for you the
applicable registration fee. All
registration fees are non-refundable, in
whole or in part, even if your domain name
registration is suspended, cancelled or
transferred before the end of your then
current registration term. Payment is by
PayPal and we may also provide you with a
payment gateway which does not require you
to log into PayPal or to have a PayPal
account.
10.0 EXPIRATION AND RENEWAL OF DOMAIN NAME
REGISTRATIONS. You agree that it is your
responsibility to keep your own records
and to maintain your own reminders
regarding when your domain name
registration is set to expire. However, we
will send you two (2) reminder emails to
warn you of the upcoming expiry date.
These emails are sent to the email address
which you have supplied us during the
domain name registration application.
However, X9 Internet reserves the option,
but not the obligation, to send additional
renewal reminders to any other email
addresses associated with the expiring
domain.
11.0 ACCOUNT CONTACT INFORMATION. As part
of your domain name registration
application you agree to provide complete
and accurate contact information. You
agree to keep this current at all times
throughout the domain name registration
term. You must submit your name, postal
address, email address and a telephone
number. If you do not provide this
information we will either suspend or
cancel your domain name registration
application, or renewal application. In
the event when the lack of current contact
information results in the loss,
cancellation or transfer of your domain
name, you agree that you shall not hold X9
Internet liable for any such loss or any
damages associated with the loss. It is
strongly recommended that you do not
provide a contact email address which is
associated with your domain name
registration, so that we can continue to
communicate, as any email address
associated with your domain name may not
be active in such an event.
12.0 DOMAIN NAME TRANSFERS. You agree that
transfer of your domain name(s) shall be
governed by the policies of the
appropriate registries, and and these
policies may be modified from time to
time. Domains may not be transferred
within the first 60 days of registration
or within 60 days of a transfer. Transfer
requests can take up to 5 business days. A
transfer will not be processed if, during
this time, the domain registration
expires, in which case you will need to
renew the domain first and then resubmit a
transfer request. You may also need to
resubmit a transfer request if there is a
communication failure between X9 Internet
and you. You understand that requesting a
transfer close to a domain's expiry date
may have risks.
13.0 PRIVACY POLICY. You agree and consent
that we make available the domain name
registration information you provide as
required by domain registries for their
whois records. You irrevocably waive any
claims you may have arising from such
disclosure or use of your information.
14.0 WEBSITE DESIGNERS. You agree that, if
you submit a domain name registration
application on behalf of someone else,
this confirms that you have the authority
from that someone else to do so and will
therefore bind that person as a principal
to all terms and conditions provided
herein. You agree that if you license the
use of a domain name registered to you to
a third party, you remain the domain name
holder on record and remain responsible
for all obligations under this Agreement,
including but not limited to payment terms
and maintaining accurate contact
information.
15.0 DOMAIN NAME EXPIRY AND REACTIVATION.
When the domain name registration term
ends, the domain name will become inactive
and may display a web page other than what
you had originally intended for it during
its term. Expired domains can be
reactivated for a period of up to 27 days
from the date of expiry.
16.0 NOTICES. You agree that all notices
served to you under this Agreement will be
made by email to the email address you
provided us for your account.

These
terms and conditions form part of the
Registration Agreement when you apply for
a domain with the .uk extension.
17.0 ADDITIONAL DOMAIN TERMS AND
CONDITIONS. When you apply for a domain
name registration with the .uk extension,
additional terms and conditions apply
which form part of our standard
Registration Agreement. You can see these
terms on the Nominet
website.
Applying for a uk domain name registration
confirms that you have read and agree with
our Terms and Conditions.
18.0 DOMAIN NAME REGISTRATION AND RENEWAL
FEES. The cost of registering or renewing
a domain name with a .uk extension is
shown on our domains
page.
19.0 DOMAIN NAME RENEWALS. You agree that
it is your responsibility to keep your own
records and to maintain your own reminders
regarding when your domain name
registration is set to expire. However, we
will send you two (2) reminder emails to
warn you of the upcoming expiry date.
These emails are sent to the email address
which you have supplied us during the
domain name registration application.
However, X9 Internet reserves the option,
but not the obligation, to send additional
renewal reminders to any other email
addresses associated with the expiring
domain. To renew your domain name you must
log into your billing manager and tick the
renewal invoice you wish to pay, then
click the 'Continue' button to proceed to
the payment page. Clicking this button
confirms that you have read and agree to
these terms and conditions. You can not
continue to make a payment if you do not
agree to these terms and conditions.
Domain renewal invoices The domain name
registration renewal fees are equal to the
registration fees and are listed on our
domains
page.
20.0 EXPIRED DOMAINS. When you do not give
a renewal cancellation notice to X9
Internet and the renewal invoice is not
paid, the domain name registration will
become ineffective after the expiry date.
You will no longer be able to show web
pages or use email with an expired domain
name registration. You may apply to have
the domain reanimated on payment of the
domain name registration renewal fee
provided we receive your application no
more than 85 days after the domain name
expiry date. Login details for the billing
manager are included with each renewal
reminder email. After 90 days your domain
name will be cancelled and deleted from
the register and made available for resale
through a third party registrar.
21.0 DOMAIN TRANSFER AND TERMINATION
CHARGES. We do not make a termination
charge to cancel a domain or a hosting
account. If you request backup data for
later use, you may contact us for a
quotation from our contact
page.
If you request a domain transfer onto
another registrar tag, there will be no
fee to pay as long as your account has no
outstanding unpaid invoices. You can raise
a dispute over an invoice by contacting us
on our contact
page.
Disputes over unpaid invoices must first
be resolved before we can transfer your
domain onto another registrar tag. You may
contact Nominet direct and request that
they transfer your domain onto another
registrar tag, there will be a fee to pay
to Nominet.
22.0 CUSTOMER SERVICE COMMITMENT. For
domain support please contact us using one
of the methods on the support
page
or contact
page.
We will respond within 1 business day or
less and aim to have any issues resolved
within no more than 5 business days. If
you disagree with any outcome of your
issue, then you may escalate this to
Nominet which is the registry for .uk
domains, at www.nominet.org.uk/disputes.
23.0 ABUSE COMPLAINTS. If you wish to
raise a complaint about abuse you have
received such as phishing scams and email
spam, please submit a support ticket from
our support
page
and we will investigate this for you
immediately.
